Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Harmony mobile application ("App"). By using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and by Apple's standard End User License Agreement (EULA), located at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If you do not agree to either, do not use the App.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. This license does not include the right to:

• Modify, copy, or distribute the App
• Reverse engineer or attempt to extract the source code
• Use the App for any commercial purpose
• Transfer your license to any third party

3. App Functionality & AI Disclaimer

Harmony uses AI-based vision and image-generation services to produce a personalized color analysis, face features reading, harmony score, hair guide, makeup or grooming suggestions, and eyewear frame recommendations from a selfie you upload. You acknowledge that:

• The report is provided for entertainment, beauty, and lifestyle inspiration only. It is not medical, dermatological, or psychological advice.
• AI analysis is probabilistic; results may vary with lighting, photo quality, and other factors and are not guaranteed to be accurate.
• Generated images are AI-produced and are intended as visual references, not photographs of real people or real garments.
• The harmony score is a stylistic indicator and is not a measure of a person's worth, attractiveness, or any objective trait.

4. Lifetime Unlock (Non-Consumable Purchase)

Harmony offers a one-time non-consumable in-app purchase that unlocks your full color analysis report ("Lifetime Unlock"):

• Harmony Lifetime — $12.99 (one-time payment, lifetime access to your generated report on this Apple ID).
• Purchases are processed by the Apple App Store and are subject to Apple's refund policies.
• Restore Purchases is available in the App's settings to recover prior purchases on a new device.

5. Auto-Renewable Subscriptions

Harmony offers auto-renewable subscriptions:

• Harmony Plus — $14.99/month (auto-renewing). Unlocks four fresh outfit ideas every week, a saved looks library, and the ability to re-analyze with a new selfie.

Subscription details:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Subscriptions may be managed by you, and auto-renewal may be turned off, by going to your Apple ID Account Settings after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

6. Photo Upload & Use

By uploading a selfie, you represent and warrant that:

• You are the person in the photo, or you have permission from the person in the photo to upload it.
• You agree that the photo will be transmitted to our AI analysis providers (Anthropic and OpenAI) for the duration of the request, as described in our Privacy Policy.
• You will not upload photos of minors without parental consent or photos containing nudity, illegal content, or other content that violates applicable laws.

7. User Conduct

You agree not to:

• Use the App in any way that violates applicable laws
• Attempt to gain unauthorized access to any portion of the App or its services
• Use cheats, exploits, or unauthorized third-party tools to manipulate the App
• Interfere with the App's normal operation

8. Intellectual Property

All content, features, and functionality of the App, including text, graphics, logos, illustrations, brand assets, and software, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You retain rights to the photos you upload; we do not claim ownership of your selfies.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AI-GENERATED RESULTS WILL BE ACCURATE OR FIT FOR A PARTICULAR PURPOSE, OR THAT THIRD-PARTY SERVICES WILL ALWAYS BE AVAILABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REPUTATIONAL HARM, OR DECISIONS MADE BASED ON AI-GENERATED CONTENT.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including if you breach these Terms. Termination of subscriptions follows Apple's standard rules.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
